Newspaper-Articles

  • 5 Apr 1865: INDECENT ASSAULT. John Holman, a middle-aged man, pleaded "Not Guilty" to an indictment charging him with commiting assaults of this nature on two young children, named Martha Beer and Martha Koenig, the first offence having taken place on the 5th December, and the second on the 21st December of last year. There were two counts in each case.
Mr. F. L Smith, who appeared for the prisoner, objected to two cases being proceeded with in one indictment, and quoted Archbold on Evidence in support of the objection.
Mr. Adamson replied that the rule providing that two cases should not be included in one indictment referred only to felonies, and did not apply to misdemeanours.
His Honour decided that the two cases could be heard together.
The principal evidence against the prisoner was the testimony of the children and that of their parents, the latter proving that Holman had made a confession to them of his guilt.
After a prolonged investigation, the jury found the prisoner "Guilty" of indecently assaulting Martha Beer, and acquitted him on the other three counts.
    Sentence was deferred.
The Court then adjourned until the following morning, at ten o'clock.7
  • 6 Apr 1865: INDECENT ASSAULT. John Holman, who had been convicted the previous day on a charge of indecently assaulting a little girl named Martha Beer, was charged with committing assaults of the same nature on a girl seven years of age, named Anna Koenig, on the 21st June, 1864, and the 25th February, 1865.
Mr. F. L. Smyth appeared for the prisoner.
The evidence for the prosecution was of the same nature as that given in the case heard the previous day.
The jury found the prisoner "Guilty"' on one of the charges, and he was sentenced to three years' hard labour on the roads. He received an additional sentence of three years' hard labour for the offence of which he had been found guilty the previous day.8
  • 3 Jun 1865: The following rewards have been granted to members of the police force during the week from the police reward fund :-To Senior-constable Patrick Murphy (950), at Dandenong, the sum of £2 10s., for his perseverance in obtaining evidence against John Hollman, sentenced to six years' penal servitude for several cases of indecent assault on children.9
