Eugene Abel, Market Gardener of Narree Worran pegged and marked with stones his selection of 46 acres, described as about 4 miles east of Emerald township, in an area known as Splitters Hut in an unnamed parish. He applied for a license to occupy his selection on 29 Nov 1870, and the application for the 46 acres was granted on 21 Nov 1871.
The map shows Cockatoo Creek running from south to north on the eastern side of his selection, and well to the north, Macclesfield.
This selection was charted by Tom Brown, contract surveyor, in July 1871.1 
Land-Gembrook10 Oct 1874Selection: GEM--65. Eugene Abel, farmer of Berwick, applied for 20 acres adjoining his present selection. It had not yet been surveyed. He stated that this would allow him access to the road, as otherwise he would be land-locked. The land was eventually surveyed as 20a 1r 8p.2 
Land-Gembrook1 Jul 1875Selection: GEM--68. Abel applied for a license under part 2 of the 1869 Land Act for a selection of 213a 2r 19p. This became CA 68, which was divided into 68A (160a) and 68B (53a 3r 2p). This land was then sold to Alexander Crichton.3

Catherine Miller Crichton, unmarried, no family, of "Glenlee" Dromana, selected and personally pegged 320 acres of land north of Cockatoo Creek on 1 July 1873, and applied for a license to occupy on the same day. It was charted in Dec 1873, and was known as CA75.
On 4 Jan 1876 there was an investigation into an anonymous letter (by 'Pro Bono Publica' which was sent to the lands department on 31 Aug 1875, suggesting there had been dummying by Miss Crichton in association with her brother David Crichton.
The investigator stated he was satisfied she was a legitimate selector. Improvements on her land were worth L255/10/- and on David Crichton's selection L130/16/-.
In an application for the renewal of her lease on 4 Apr 1878 Catherine stated that improvements were worth 1284/18/-. There was a lot of fencing, and a 5-roomed house 42 x 33 feet, which had brick walls and a paling roof. She also had a dam and a well.
On 3 May 1878 she had 134 acres under grass, and had resieded on her brother's adjoining lease.2

  • 13 Jan 1926: ELDERLY WOMAN KILLED. PHAETON FALLS 30 FEET. Bolting Horse Runs Off Road. Four persons were thrown out of a phaeton when it fell 30 feet off a roadway near Dromana last night. One woman was killed and her brother seriously injured.

    CRICHTON Miss MARGARET aged 83 years, of Boneo, a small settlement near Dromana.

    CRICHTON Mr JOHN aged 86 years, of the same address a brother of the dead woman.
    Fractured ribs.
    Also in the phaeton were two girls, a niece and a friend of Miss Crichton. They were also thrown out but were suffering mostly from shock. Nobody witnessed the accident but the Dromana police have learned that the occupants were on their way to Dromana and that Mr Crichton was driving the phaeton along the road from Arthur's Seat. About two miles from Dromana, the horse, a high spirited animal, evidently became frightened and bolted. It is believed that it ran off the road at a sharp bend and plunged down the embankment. Thirty feet from the roadway the vehicle was stopped by two trees and then overturned, the occupants being thrown out.
    Miss and Mr. Crichton were crushed underneath the phaeton, Miss Crichton being killed instantly. The girls were thrown clear and one of them managed to mount the horse which had broken away from the vehicle. She rode into Dromana for assistance and returned with Constable Nolan, a doctor and a civilian.
    Mr Crichton was taken to a private hospital at Dromana and admitted in a serious condition.7

Dear Sir, I would respectfully ask ... do your utmost to ... give me authority ... occupy the land recommended to me on 24 June in the Parish of Gembrook, I am ... waiting same, stock is starving for want of grass + ... want to get ready to turn off in the summer or I will loose a year.
I have not seen anything ... Crown Lands Bailiff ... report on fencing, I might state that the fencing referred to has been standing about 17 years + what portion has not been burnt by the bush fires + broken by fallen trees is utterly rotten the fact can be readily seen by the fact that 17 years is the full life of a fence built of local timber + on steep hillsides which tends to make it fall. Post + wire is the fence suitable fore here on account of the heavey bush fires + the remaining portions of the fence might be destroyed by fire at any time + will require daily attention to keep in order falling portions taking all things into consideration the fencing is worth almost nothing and it would be more profitable for me to erect a wire fence at the start + save further trouble.

Dear Sir, I have some doubts as to what Blocks of Land you are giving me in parish of Gembrook as in correspondence you mention area 218 acres + mention blocks No 127B 127A + 127C and not mentioning Block 127. On applying for this land I asked for blocks 127 127B 127A + 127C with the portion marked thus + cut off on northern boundary of block 127A on a sketch herewith I have shown in Red Ink the exact area + Blocks I wished to obtain + and contains about 206a 0r 19p and then block No 97 contains 100 acres about. If you do not wish to take off the portion marked x on block No 127A you may give it to me only it takes a lot more fencing + the land is so poor that it is hardly worth the fencing.
I have paid £5 deposit survey fee on 218 acres + £6.14.0 for the 100 acres.

Land-Note8 Oct 1908 GEM--97. On 8 Oct 1908 Robert Auhl applied for a lease on his selection 97, and the issue of a lease for 34 years was recommended, and approved by the Board of Land and Works on 4 Mar 1909.
Details of application:
DECLARATION BY LICENSEE.
Note.—If the licensee is not in a position to declare to clauses 3, 4, and 5, he is at liberty to strike them out, and to explain fully the cause of his non-compliance with the conditions therein specified.
I, Robert Auhl of Gembrook West, being the holder of a licence to occupy the above-mentioned allotment, declare as follow :—
1. That I have paid all fees due on the said licence.
2. That I have not at any time assigned or sublet the said allotment or any part thereof, or transferred my interest therein in whole or in part.
3. That within six years from the issue of the said licence the said allotment was enclosed with a good and substantial fence.
4. That within one month from the issue of the said licence, and thenceforward during the continuance thereof, I resided for a period not less than siz years on the said allotment, or within 5 miles thereof.
5. That before the end of the sixth year from the commencement of the said licence I made upon the said allotment permanent and substantial improvements of the value of £1.15.3 for every acre and fractional part of an acre contained therein.
6. That I have complied with all the other conditions of the said licence.
7. That I make this application in conformitywith the provisions of the Land Acts, and not in violation of any of them.
8. That the statements and the answers given by me in reply to the questions hereto are true and correct in every particular.
Robert Auhl erected 40 1/2 chains of post and rail fencing, also 88 chains of post and rail and 5 galvanised No 8 wires, 14 chains of division fences post and rail, and 11 chains of division fencing post and wire. In addition to that he erected 500 yards of wire netting, to a value of £87
The adjoining occupiers of the adjoining lands, WC Johnson and JR Buxton, contributed £15.17.0.
He stated that the buildings erected by him to be used in connection with the land was described on lease form of improvements on block 127.
The selection had natural springs, so no water storage was necessary.
His other improvements consisted of ringing timber on 100 acres, valued at £12.10
Clearing of ten acres for cultivation, valued at £50
and cutting saplings & scrub and burning off, valued at £25.
The total value of his improvements were £174.15.0
He stated that his dwelling-house consisted of four rooms, but that is was on block 32B2.
He made this declaration at Thoona on 5 Oct 1908

The Crown Lands Bailiff, who inspected the property on 7 Dec 1908, valued the improvements at £142.6

  • 14 Jul 1893: MIEPOLL. Mr Auhl, of Miepoll, has erected a complete sawing plant on the Seven Creeks, where he is engaged in a contract of sleeper cutting for the Department.
    He is also prepared to execute orders for building purposes, and for contractors.
    The desireability of residents in this part having timber within easy distance has been a long felt want, and it it to be hoped Mr Auhl will receive a ready support for his plucky enterprise.32
  • 18 May 1894: DIPHTHERIA VICTIMS.—The number of deaths from diphtheria at Miepoll is now six—three of Mr Cork's children, two of Mr O'Brien's and one of Mr. Auhl's.
    DIPHTHERIA.—We sincerely regret to record the death of another child of Mr Cork, Miepoll, from diphtheria. Several other members of the family are at present in the Mooroopna Hospital suffering from the same complaint. Sarah Auhl33

  • 25 May 1894: DIPHTHERIA.—Still another death has taken place in Mr Auhl's family, at Miepoll, this being the second child taken from this family by diphtheria. A third child, we regret to say, is in a very dangerous condition from the same disease.   • 1 Jun 1894: DIPHTHERIA.- Great sympathy is expressed on all sides for Messrs. Auhl and Cork, of Miepoll, who have again lost another child each from diphtheria, this being the fourth fatality in the Cork family and the third in Auhl's. These deaths, with the two children of Mr O'Brien, bring the total victims of diphtheria at Miepoll to nine.

    The Board of Health dealt with the following business at last meeting : From the Health Department, acknowledging receipt of health officer's report on diphtheria at Miepoll.—Received.
    From inspector of nuisances, as follows: —Gentlemen,—I have the honor to report that I have visited Miepoll. Messrs J. O'Brien and Robt. Auhl have made alterations in their premises in accordance with Mr. Taylor's report. The pigsty has been removed from O'Brien's premises, and Auhl has removed the pit from his closet and substituted a pan. Miepoll Butter Factory.—The drains are thoroughly disinfected, but no material alterations have been made for the reception of the drainage. I visited Mr T. F. Cork's premises. The houses are very clean and well kept.38

  • 17 Dec 1902: Berwick Shire Council. Correspondence. From Robert Auhl, Gembrook, protesting against the high valuation of his property in Gembrook ; also requesting that the scrub be cut down on road along the garden fence of the property lately owned by Jacob Machlen, as same endangered the fence in case of fire.—The matter of valuation was too old to be entertained. On motion of Cr. James and Martin, the matter of clearing be referred to the clerk of works.44
  • 8 Jun 1904: Berwick Shire Council. Correspondence. From R. Auhl, forwarding Mrs. Martin's consent to his purchasing a piece of unused road at Beaconsfield.—On motion of Crs. Grant and Wilson, consent given.45
  • 26 Jan 1906: PAKENHAM, Thursday. — At West Gembrook on Tuesday the fire swept across from the direction of Cockatoo Creek, burning an empty weatherboard building to the ground. It then reached Mr Auhl's property. Mrs Auhl, who was in the house with some of the children, escaped. The house and its contents were completely demolished. Mrs Auhl with her children had to take refuge in the cellar to save themselves. A large fire is still burning at South Gembrook. At Nar Nar Goon a lot of fencing was destroyed. A settler on the No. 1 drain lost his house and outbuildings. Sarah Auhl46
  • 14 Feb 1906: Berwick Shire Council. Correspondence. From R. Wade, Gembrook West, notifying a deserving case of loss by the late disastrous, bush fires, Mr R. Auhl having lost everything, including the homestead and contents; also the stable, with harness and about 4 tons of hay, trap, roller, a quantity of tools, 12 fowls; in fact everything on the place but a few milk dishes in the underground dairy.—It was decided that the President draw attention of central committee to this case and any others that may be brought under his notice.47
  • 14 Feb 1906: The Bush Fires
    Speaking on the above subject at the meeting of the Berwick shire council last Saturday, the President, in referring to a letter received from Mr Wade, postmaster at Gembrook west, stated the communication was in answer to one he had written inquiring what damage had been done by the fires.
    Numbers of people had lost sheds, out-buildings, crops, etc., but one case was a particularly hard one. Mr Auhl had hewn a home for himself in the forest, and all had been now swept away by the fire. He thought they might vote a sum from the council funds.—Cr D. Bourke concurred in this, but considered the money should be sent to the central committee. A meeting was being held in the hall there that evening to rise funds, and meetings were also being held in other parts of the shire for the same purpose. - Cr McNamara favored sending the money to a local committee, the central body being too slow in acting, and immediate assistance was necessary. Money subscribed by the public on a previous occasion for the same purpose had been spent on the Yarra.—Cr . D. Bourke said if that was true it was wrong; he was not aware of it.—Cr Wilson doubted whether they had the power to vote money for this purpose; he would be more inclined to see if any people in their own shire were in need.
    —Cr T. Bourke stated this was an exceptional case. They might have more before the summer is over, then they would be in an awkward position.—Cr D. Bourke moved that the President be empowered to bring Mr Auhl's case before the Central Committee, also any other cases that may come under his notice.—This was seconded by Cr. Barr and carried.48

  • 14 Sep 1906: NEW BUSINESS AT THOONA.—The announcement appears in another column that Mr. Robt Auhl has taken over the management of the Thoona Implement Works, lately carried on by Mr. J. Richards. All kinds of engine, machinery and vehicular repairs will be undertaken, and in order to keep pace with the times, stock to the value of hundreds of pounds is being put into the business.50
  • 12 Feb 1909: M. Q. M'Namara's Sales. — The following important sales will be conducted by M. Q. M'Namara on the dates mentioned below:—On Wednesday, 24th February, Thoona stock sale; also on account of Mr. Robert Auhl, of the Thoona Implement Works, the whole of the factory plant and a large quantity of vehicles, farm implements, etc.51

    At the Commercial Hotel, Thoona, on Saturday evening last, a very large number of people met for the purpose of presenting Mr. Robt. Auhl (late of Thoona Implement Works) with a small memento, as a token of esteem in which he is held by the people and members of the Thoona Race Club, on the eve of his departure from the district. Mr. W. J. Tonkin, who occupied the chair, in making the presentation said that Mr. Auhl, their guest, had only comparatively been a short time in the district, but during that time he had been intimately associated in many ways in public matters. He had always worked openly and disinterestedly in public interests and his removal would there fore be a distinct loss. The matter of giving Mr. Auhl a small token of appreciation had only been mentioned that afternoon, and had originated from the Race Club. The members of that body recognised the work that he had performed as hon. sec. for the past two years.
    He had shown organising ability, upon which the formation and successful conduct very largely indeed depended. The club would have very great difficulty in filling his place. Mr. Auhl had unfortunately come into the township as manager of the Thoona Implement Works at a very bad time and had experienied the bad seasons. He (the chairman) trusted that Thoona had seen the worst, and that from henceforth at least for a few seasons things gradually would improve. Mr. Auhl would have the best wishes of the residents of Thoona — and especially the Race Club — wherever he went, and he hoped he would continue to receive the reward which his honesty of purpose and energetic work in the public interest well merited. Mr. Tonkin then presented the guest with a very handsome silver-mounted ivory laid set of carvers in a handsome case.
    Mr. Auhl replied and said I thank you for this unexpected present and all the kind things said this evening. I am sorry I am going. Since I have been amongst you I have received nothing but kindness from you all. I have only done what I consider my duty to the Race Club, and will at any future time be only too pleased to give whatever assistance I can. I think that in a place such as this all should join in, instead of leaving the public affairs to be carried on by two or three, as is the general rule. I am sorry that the clubs assets appear to be going down, but I have done my best for them, and I hope that in the future they will improve. I thank you for the valuable present ; I am sure that it will be treasured at home, and I am sure that it is much better than a great many articles which only would have been suited to myself. I thank you for your past favors ; and I will always remember the Thoona people and the members of the Race Club with pleasure.
    The usual toasts followed and were drank with musical honors, and a very pleasant time finished the farewell with a hearty vote of thanks to the chairman.52
  • 18 Jun 1909: THOONA. During the past few days Mr. Robert Auhl, contractor, has been busy in putting an acetylene lightiug plant on to the Presbyterian Church building and V.M.R. Hall. The hall has been lit with the gas for some time, and the results have been most satisfactory to all concerned. It was through this trial that the Presbyterian Church committee decided on having it laid on to their building.53

  • 18 Apr 1910: Burglaries, etc. Berrigan.—Stolen, between the hours of 9 p.m. the 26th and 7 a.m. the 27th ultimo, from the residence of Robert Auhl, Budd-street, Berrigan.—A black enamelled bicycle, "Princess" on front, all the letters of which, excepting "ess," are obliterated, solid diamond-shaped cranks, dust-caps missing from both pedals, leather handle tips, the stitches in one broken, American manufacture, value £5 10s. Identifiable.56

Nothing had been done to the road for four years, and the road was full of ruts; a culvert had collapsed, and the approaches to Bourke's bridge were in a very bad state. Some repairs had been made, but they were poor in character.

    In connexion with the list of Registered Motor Cycles in this issue of the Police Gazette, the police are informed that any cycle, the number of which is not given is unregistered, and if observed in use should at once be reported to the Chief Commissioner.
    It will be observed that the due date for renewal of each cycle is given, and the police are instructed to see that registration is renewed on such date.
    The police of each sub-district are expected to pay particular attention to the cycles in their sub-district.
    Any neglect of this instruction will be regarded as serious, and be dealt with accordingly.

  • 18 May 1917: To the Editor. Sir—It should be of great interest and practical advantage, that of having a local paper in our midst, particularly for the Gembrook and Cockatoo portions of the Shire of Berwick, which have been very much in the dark as to what is going on around us, and practically no opportunity of making known the conditions and wants and wishes of the people. The paper should be of great benefit in many ways, and particularly in dealing with council matters. There are also many items of district news which should appear in a local paper, and which would, make interesting reading, and its publication be of advantage to the district. We need in these somewhat backward districts all the local or other information obtainable, suitable and helpful in the advancement of the district. The pioneers have their work cut out, and not much time at their disposal for recreation, or facilities to get about to obtain information requisite for the many branches connected with general farming, or to enable us to make the best use of the few advantages we might have. One of our chief drawbacks is bad roads. The Country Roads Board made a start to improve matters, and all sorts of promises were made by Parliament to provide good roads, but they now say that the funds are not available. It is to the advantage of this or any district to have a local paper, in fact I have, in my time found it very essential, and I think it is to our advantage to support it to our utmost.—Yours, etc., R.   • 18 May 1894: DIPHTHERIA VICTIMS.—The number of deaths from diphtheria at Miepoll is now six—three of Mr Cork's children, two of Mr O'Brien's and one of Mr. Auhl's.
    DIPHTHERIA.—We sincerely regret to record the death of another child of Mr Cork, Miepoll, from diphtheria. Several other members of the family are at present in the Mooroopna Hospital suffering from the same complaint. Robert Frederick Auhl13
  • 25 May 1894: DIPHTHERIA.—Still another death has taken place in Mr Auhl's family, at Miepoll, this being the second child taken from this family by diphtheria. A third child, we regret to say, is in a very dangerous condition from the same disease.   • 1 Jun 1894: DIPHTHERIA.- Great sympathy is expressed on all sides for Messrs. Auhl and Cork, of Miepoll, who have again lost another child each from diphtheria, this being the fourth fatality in the Cork family and the third in Auhl's. These deaths, with the two children of Mr O'Brien, bring the total victims of diphtheria at Miepoll to nine.

  • 26 Jan 1906: PAKENHAM, Thursday. — At West Gembrook on Tuesday the fire swept across from the direction of Cockatoo Creek, burning an empty weatherboard building to the ground. It then reached Mr Auhl's property. Mrs Auhl, who was in the house with some of the children, escaped. The house and its contents were completely demolished. Mrs Auhl with her children had to take refuge in the cellar to save themselves. A large fire is still burning at South Gembrook. At Nar Nar Goon a lot of fencing was destroyed.   • 9 Sep 1919: Death of father: WILSON.— On 6th September, at Wangaratta Hospital, Wm. Wilson, Benalla (late of Goorambat), beloved husband of Ellen Wilson; father of Mrs. Auhl (Gembrook), Mrs. W. Matthews (W. A.) Mrs. P. Galli (Clifton Hill), Ted, Tom, Etta, and Mrs. H. Walker (Berrigan), aged 70 years.17
  • 9 Mar 1920: Death of mother: OBITUARY. Mrs. William Wilson
    On Thursday night the death occured of Mrs Ellen Wilson, of Lowry Place, Benella, aged 79 years, the cause of death was general break up of the system. Deseased was a resident of Goorambat and Benalla for some years and came to Australia from Tipperary, Ireland, in 1863. Deceased leaves a family of two sons and five daughters—Thomas and Edward Wilson, Mrs R. G. Auhl; Gembrook; Mrs. Matthews, W.A; Mrs. Galli, Clifton Hill; Mrs. H. Walker, Berrigan; and Miss Wilson, Benalla. The remains were interred in the Benalla cemetery on Saturday. The burial service was read by the Rev. Dr. Myers and the mortuary arrangements were in the hands of Mr. Abbott.18
  • 8 Sep 1932: Following the unfortunate death of Mrs. Sarah Auhl, the circumstances of which are referred to elsewhere in this issue, her funeral moved to the Dandenong cemetery, on Tuesday.
    Prior thereto the body was removed to the Methodist Church, where a brief service was held by the Rev. B. L. Semmens, who became assisted by Mr. Singleton, Mr. Gay, of Pakenham, and Adjutant Gregor and Lieutenant Cahill, of the Salvation Army. Miss Cadle officiated at the organ, when there were sung, “Jesu, Lover of My Soul,” and “Rock of Ages.” Mr. Semmens read the burial service, and was aided by those who took part in the church. The funeral was conducted by Mr. Garnar. For nine years Mrs. Auhl had been a widow, and she has now left a family of one daughter and five sons, for whom profound sympathy is felt.19
  • 22 Sep 1932: Magisterial Inquiry. “ROAD LIGHTING IS NOT EFFECTIVE,” SAYS PLAIN-CLOTHES CONSTABLE McINTYRE.
    There was held, at the Dandenong Court House, on Thursday, 15th inst., a coroner's enquiry into the death of Mrs. Sarah Auhl, who, on Sunday night of the 4th inst., was, killed whilst crossing the road, in Lonsdale street, known as the Princes Highway. Mrs. .Auhl was on her way to church, at the time mentioned.
    Mr. Francis Field, solicitor, appeared in the interest of the family of Mrs. Auhl, and Mr. Wallace Ball was present in representation of the driver of the car concerned in the fatality.
    Constable Fletcher appeared on behalf of the police, and the depositions were taken by Plain-cothes Constable Mclntyre.
    Percy Augustus Auhl stated that deceased was his mother. She was 66 years of age, and resided at 14 Jarvis street, Dandenong.
    To Mr. Field; His mother had good sight, and she was slightly deaf. It was difficult for her to understand, unless one spoke-loudly. Her hearing was sufficient to enable her to distinguish a motor horn.
    To Mr. Cunningham: She had been active and agile. Her sight was good, and she had been in the habit of crossing the road there frequently.
    Dr. Ellen Walker said she had performed an examination of the body of Sarah Auhl, whose death had been due to haemorrhage and shock. Several ribs were broken, and there was certain severe internal injuries. She had been struck by the car rather towards the back. The car could not have been travelling at more than; a moderate speed. She did not think the car had run over deceased—though of that she had no idea to the contrary, since she had not seen the accident.
    Mrs. Westmoreland stated on Sunday, 4th September, she saw a woman hit by a motor car, which was on the left side of the roadway. She was 60 yards away. She saw a car swerve, and saw a woman on the bonnet. The collision she thought had occurred on the left side of the road; the woman had been passing under the light, which was clear. She had not known Mrs. Auhl.
    To Mr. Ball: It was a clear night ; though at the time, quite dark. There appeared to be a heavy line of traffic going through to and from Dandenong.
    Mr. Llewelyn Llewelyn, tailor, residing in Dandenong, on Prices Highway, had seen and heard an accident.
    He was a car driver, and he estimated the speed as being approximately 12 to 14 miles per hour. There might have been the rumble of a horn. He heard a sound of breaking glass; that and the swerving had attracted his attention. He stood within 35 yards of the accident. There were no cars coming in the opposite direction. The car which struck Mrs. Auhl had head lights burning. The woman apparently had been walking from Henty street, diagonally, to Robinson street. The car had not travelled beyond its own length, when the woman was struck.
    To Mr. Ball: Cars were following along the Highway—one behind the other. He had seen the car turn, possibly, to avoid deceased.
    Horace Davidson, carpenter, of Close street, stated he had heard a swerving sound of a car travelling possibly at a speed of 25 miles per hour. He was not a driver himself. It was a clear night, though rather dark. He had observed no collision, and his attention had been drawn by the sounding of a horn, with brakes intermingled.
    To Mr. Ball: When the car passed, him, in Close street, it was two chains away when he heard the crash. As to whether the car had diminished its pace, after passing him, witness did not know.
    Samuel Park, chemist, of Ripponlea, was a passenger in the front seat of a motor car, driven by a Mr. Short, when the mishap occurred.
    To Mr. Field: They had come from San Remo. Between he and the driver there had been little conversation, and none when the accident happened. Their speed was slow, though what it was he could not say.
    To the Coroner: He had no experience of car driving, and the driver he was sure had not been talking to him then.
    Norman C. Short, a motor driver, residing at Carlton, said he was driving a Rolls Royce car, at about 20 miles per hour, at 7 p.m. on 4th September. He saw a woman, who proved to be Mrs. Auhl, on the Princes Highway, near Dandenong. She had been struck by his car. Another car had been 20 yards ahead of him. He saw the woman running across the road from his right to left side. When he saw her she was five yards ahead of him. He swerved to his right, to avoid her, and had his brake on. The car struck and knocked her to the ground.
    His left front mudguard and left lamp struck her.
    - To Mr. Field: The brakes were perfect. He was travelling at not more than 20 m.p.h. On the road he had kept a good look-out. His headlights were excellent. He never saw Mrs. Auhl until he saw her running towards the car. Quickly he applied the brake—pulling up within six yards. The woman had been running. Had he turned his car to the left it certainly would have struck her.
    There was a ray of light from another car in the distance; He had left San Remo after lunch, and had stopped on the road. He did not sound his horn; There was no time.
    To Mr. Ball: He had been driving at even speed. Mrs. Auhl appeared as running fast. Her hands were above her head, and she was trying evidently to dash across.
    To the Coroner: He had not seen her prior to the moment; He was moving carefully. His eyes were always watching the road when driving.
    For many years he had held a licence, and that has never been endorsed.
    Mrs. Auhl appeared to have moved, out of the shadow, onto the roadside near him.
    Plain-clothes Constable Mclntyre gave evidence concerning those enquiries made by him immediately after the fatality. He regarded the road, lighting, at the scene, as scarcely effective. There is a street light near the footpath, at Henty street, but it does not illumine the Highway. That light is 35 yards from the scene of the accident and the other, nearest light, is 50 yards away. He was satisfied as to the condition, of the driver of the car concerned. He had seen him within 15 minutes of the accident,
    and there was nothing to suggest he was other than perfectly normal.
    VERDICT.
    The Coroner’s finding (Mr. J. H. Cunningham, JP.) was that Sarah Auhl died, at Dandenong, on 4th September, from haemorrhage and shock, caused accidentally, on her crossing the road, and being struck by a motor car.20
