    A young man named William Orchard, aged 21 years, a resident of Cockatoo Creek, was accidentally killed at Yarra Junction yesterday morning. Deceased was employed at felling trees by Cuming, Smith and Co., at their No. 3 mills. He was working in company with his uncle sawing a log through when a limb of a tree under which he was standing fell on him, crushing his head and breaking his legs. When taken from under the limb the unfortunate young man was dead.9

    Dr. Youl held an inquest, Monday, on the body of a youth named William Orchard, nineteen years of age, the son of a farmer at Gembrook, who was kicked on the head by a Horse on the night of Friday last. The frontal bone was driven into the brain, and the deceased was taken to the Alfred Hospital, where he was attended to by Dr. Backhouse, but died half an hour afterwards. A verdict of accidental death was returned.6

    I, George John Derrick of 96 Derby Street Kew in the State of Victoria Dairyman make oath and say:
    1. That I am the abovenamed Petitioner.
    2. That I was on the twentyfifth day of March One thousand eight hundred and ninety one lawfully married to Mabel Alice Derrick (then Mabel Alice Unwin and hereafter called the Respondent) at Pakenham by the Reverend Robert W Rock according to the Presbyterian Church rites.
    3. That I am of the age of 49 years and was born at Munthum South Australia and am domiciled in the State of Victoria.
    4. That the respondent is of the age of 43 years and was born at Euroke in the State of Victoria (as I believe from statements made by her) and is domiciled in the State of Victoria.
    5. That prior to the said marriage I was a dairyman and both before and since have earned my living as a dairyman.
    6. That prior to the said marriage Respondent was a domestic and earned her living as a domestic and since such marriage Respondent was supported by me up to the time she deserted me as hereinafter appears and since that time has been supported partly by me and partly by her own exertions as Manageress of the Glen Tea gardens.
    7. That there are three children the issue of the said marriage namely Lena Emma a female born at Packenham and now 22 years of age, Walter George a male born at Packenham and now 21 years of age and Percival Eric a male born at Malvern and 15 years of age.
    8. That the Respondent has without just cause or excuse wilfully deserted me and without any such cause or excuse has left me continuously so deserted during three years and upwards.
    9. Immediately after marriage Respondent and I lived and cohabited at Packenham for about two and a half years when we went to reside at Barramundah for about six months. We then returned to Packenham where we lived for about six months and then went to reside at Malvern where we continued to reside until the month of January 1908 when Respondent deserted me as hereinafter mentioned.
    For sometime prior to the year 1906 Respondent was dissatisfied and on many occasions told me she was tired of me and wanted to have her own free way and that she was going to leave me.
    In or about the month of January 1908 I went to my work as usual and on my return I found that Respondent had left me taking her personal effects and some other articles such as Pictures &c. She left a note for me to the effect that she was leavine home never to return to me.
    Shortly after she issued a maintenance summons against me and an Order was made for the payment of £1 per month at the Malvern Court.
    I have on numerous occasions since then seen the Respondent and asked her to return to me but she has always refused and I also about two years ago wrote and asked her to return to me but she did not answer the letter.
    A friend Nurse Stewart made an appointment with the Respondent and me last week with a hope of affecting a reconciliation. I saw the Respondent at Elizabeth Street and asked her to return to me but she refused and said she was managing a business and was quite comfortable and the following day Respondent wrote me as follows:—
    "Glen Tea Gardens, Hawthorn. 10.12.14.
    Dear George,
    re our interview on Thursday eve last after thinking a great deal of the matter I have still come to the same decision re our union it can never be as I feel I have had my liberty too long trusting not to refer to the matter again
    Yours faithfully, Mabel Alice Derrick
    Sexual intercourse finally ceased between Respondent and me in the month of January 1908 and has not since been resumed.
    13. That no Deed of Reparation has ever been drawn up or executed between respondent and me.
    14. That I have not sooner instituted these proceedings because I have not had the means to do so.
    15. That I distinctly and unequivocally deny all collusion past or present directly or indirectly with the Respondent or any person likely to be made Respondent.
